TERMS AND CONDITIONS

 

Introduction

These are DTM Heating and Plumbing Solutions LTD Terms and Conditions and they tell you:

What you can expect from DTM Heating and Plumbing Solutions and your rights and responsibilities.

When Terms Apply

Please ensure you read these terms before using our services, by using our services you agree to these terms, our privacy policy and terms of use.

What do we mean by services

Anything offered by DTM Heating and Plumbing Solutions LTD:

Quotations, Servicing, Installation, Repairs, Upgrades, Emergency call outs.

Terminology

Us/We/Our refers to DTM Heating and Plumbing Solutions LTD.

You refers to you; the customer or person instructing us on behalf of an organisation to carry out work or supply materials.

Tradesperson refers to the representative appointed by DTM Heating and Plumbing Solutions LTD to carry out work.

We reserve the right to refuse or decline to undertake any work.

We reserve the right at our absolute discretion, to designate the tradesperson who will represent us.

Hourly Rate Work

The total charge to you will consist of the cost(s) of:

Labour (the amount of time spent by the tradesperson carrying out work) including all reasonable time spent obtaining non-stocked charged by us at our hourly rate.

You will only be charged for time spent related to your work all other time i.e. lunch breaks are non-chargeable.

Fixed Price Work

The total charge to you will be given as a firm cost (manifest of errors exempt), inclusive of labour and materials.

Where a written estimate has been supplied to you the total charge in the estimate should not exceed the time taken by more than 20% but may be revised in the following circumstances:

1)If after the submission of the estimate, you instruct us (in writing or verbally) to carry out additional work not referred to in our estimate.

2) If after submission the cost of materials increase

3) If after submission of the estimate, it is discovered that further work needs to be carried out which were not anticipated when the estimate was prepared.

4) If after the submission it was discovered there was a manifest error when the estimate was prepared.

We will only be bound by estimates given in writing.

Satisfaction

DTM Heating and Plumbing Solutions LTD are committed to providing a professional top-quality service to every customer. If after we have carried out work, you are not wholly satisfied with our service you must provide us written notice within 12 months. You must allow us, our insurers, the opportunity to both inspect and carry out remedial work where appropriate. If you fail to notify us as outlined above, we will not be liable in respect to any defects in the work carried out.

Guarantee

For your peace of mind, we provide 12 months guarantee on labour carried out by DTM Heating and Plumbing Solutions in respect to any faulty workmanship only. This is active from the date of completion.

The guarantee will become null & void if the work/appliance completed/supplied by us is;

1) Subjected to misuse or negligence.

2) Repaired, modified or tampered with by anyone other than a DTM Heating and Plumbing Solutions Ltd tradesperson.

 

We will not guarantee any work undertaken on instruction from you against the written or verbal advice of the tradesperson.

We will not guarantee work in respect of blockages in waste or drainage systems.

Work is only guaranteed in respect of work directly undertaken by us and full payment having been made. Any non-related faults arising from recommended work that has not been undertaken by us will not be guaranteed.

Where we agree to carry out work on systems of inferior quality (over 10 years old) no warranty is given in respect of such work and we accept no liability in the respect of the effectiveness of such work or otherwise.

We will not be held responsible for failure of parts due to normal use required by maintenance procedures. Occasionally maintenance will highlight any underlying issues most commonly Printed Circuit Board or fan failure. When the power to the appliance is switched off any faults can become apparent these faults would have shown in the event of a powercut or power being switched off by the user.

Liability

We will only be liable for rectifying our own guaranteed work and will not be held responsible for any ensuing damage or claims resulting from other work overlooked or subsequently requested and undertaken at the time.

We will not be held responsible for any damage or defect resulting from work not fully guaranteed, or where recommended work has not been carried out. Work will not carry a guarantee where you have been notified by the tradesperson either verbally or indicated in ticked boxes or in our comments/recommendations.

We shall not be held liable for any delay, or consequences of any delay, in performing our obligations if such delay is due to any case beyond our reasonable control and we shall be entitled to reasonable time extensions.

We will be entitled to fully recover the costs of damages from any tradesperson whose negligence or faulty workmanship makes us liable to pay for those damages or rectification of work.

You will be solely responsible for any hazardous situation in respect of the gas safe regulations or any Gas Warning Notice issued by a DTM Heating and Plumbing Solutions tradesperson.

Title to goods

Goods shipped and delivered by us to you, or your premises, shall remain our property until paid for by you in full. While goods remain in our property we have the absolute authority to:

1) Retake, sell or otherwise deal with or dispose of all or any part of these goods.

2) Seek a court injunction to prevent you selling, transferring or otherwise disposing of such goods.

General

These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorized representative and you. Our terms and conditions will prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions.

 

 

Right to cancel

Under the Consumer Contracts Regulations 2013 you have the right to cancel this contract during the 14 day period from when we issued our contract, if you decide to cancel within this 14 day period any money paid by you will be refunded. If you decide for work to commence before the 14 days cancellation period expires you will be required for any services or goods already provided. Notice of cancellation is required in writing via email, text, or sent by mail cancelation is accepted from the day it is received by DTM Heating and Plumbing Solutions.

These terms and conditions and all contracts awarded between us and you, shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Law

Work commencing prior to expiry of cancellation period

I/We agree that: DTM Heating and Plumbing Solutions may commence work on.___________________

before my cancellation period has expired. I understand if I decide to cancel within 14 days I/we will be responsible for any work that has been done up to cancellation.

Acceptance of Quote/Estimate

I accept the terms and conditions of DTM Heating and Plumbing Solutions Ltd and agree for work on quote number _____ to proceed. I understand immediate payment of cleared funds is due upon completion of work.

Powerflushing Terms and Conditions

 

1. These terms & conditions are in addition to our standard terms & conditions and should be read in conjunction with our standard terms & conditions.

2. When requesting or confirming a booking to have a powerflush carried out, you are confirming that you have read understand and agree to be bound by these and our standard terms & conditions.

3. A Powerflush is a method of restoring heating performance to an old heating system, by connecting a high performance reservoir pump into the heating circuit and pumping a number of chemicals at high velocity around the system to break down any limescale & sludge deposits (Magnetite). Then pumping the deposits out of the system to a drain, until the system water runs relatively clear. Then a chemical inhibitor is added to the system to help prevent the build-up of sludge deposits in the future.

4. Although a “powerflush” is the best way to restore and cleanse a system we cannot guarantee to completely clear all deposits from all systems and on very rare occasions the improvement in a systems performance is limited. This can usually be rectified by a second flushing of the system which we can carry out at a discounted rate. On even more rare occasions, blockages can be so severe in certain sections of pipe work, that these sections of pipe work may need cutting out and replacing, if this is necessary an extra charge will be made to the customer.

5. All work carried out that incorporates a powerflush will be carried out in a professional manner following industry standard methods. Corrosion and Scale cause internal damage to the central heating system and boiler. Depending on how advanced this damage is, leaks may occur during or after the powerflush. The power flushing doesn’t cause the leaks but it can uncover leaks that have been sealed up by the sludge or lime scale inside the system which is removed during the power flushing process. Unfortunately there is no way of telling if leaks are going to occur. 

6. “DTM Heating and Plumbing Solutions Ltd” cannot be held responsible for any leaks that occur or for any damage caused to decorations, furnishings (including carpets), fittings, existing pipe work, cylinders or tanks, caused while carrying out the powerflush. Therefore any leaks or damage caused by leaks, are not covered under our guarantee. (However this may be covered under your house insurance). Whilst the chance of a leak occurring during power flushing is rare, leaks generally occur while we are on site so we can deal with them straight away.

7. In the unlikely event that during the power flushing process any leaks should occur, repairs will be carried out at our standard hourly rate.
